USMS Cass Custody Role
The United States Marshals Service prisoner program manages federal prisoners during pretrial detention, court appearances, sentencing, and transport. It can use local or contract facilities. Research did not establish a Cass-specific USMS detention contract or a USMS detention center in Cass County. A physical stay in a county jail does not convert the federal case into a county prosecution.
USMS custody is different from BOP imprisonment. BOP primarily handles people serving sentenced federal terms and provides a public locator. USMS commonly handles the period before trial or sentence and movement between courts and facilities. A person can pass from Cass custody to USMS and later to BOP, but each handoff is a transfer until an order and release event show otherwise.
Confirm USMS Cass Release
There is no comparable USMS public historical person locator documented in the research. A blank BOP search cannot fill that gap because BOP and USMS cover different phases. Begin with PACER, the federal court records system, and locate the case’s detention, release, commitment, or transport-related order.
- Identify the federal case number, court, and exact defendant name from a reliable court source.
- Open the PACER docket and locate the detention hearing, detention order, release order, bond conditions, judgment, or later revocation order.
- Note the order date and its precise terms. Do not treat the filing time as the physical exit time.
- If a local jail held the person, request its admission, movement, discharge type, and receiving-agency record.
- Use a focused USMS FOIA request for a specific existing agency record when the public docket and facility record leave a material gap.
The order supplies legal authority. The facility movement record can show when staff transferred or released the person. A USMS record may document transport or custody acceptance. Only their combined timeline can distinguish a federal bond release from transport to another jail, a BOP designation, or an ICE handoff.
Note: A docket entry saying an order was signed does not guarantee that all release conditions were met at that same moment.
USMS Federal Release Orders
Federal pretrial records can include an initial appearance, detention hearing, temporary detention, an order of detention, or an order setting conditions of release. Later records can modify conditions, revoke release, or commit the person after judgment. Use the exact court language. “Released on conditions” differs from a case dismissal, and a transport order differs from either.

Sealed records and access rules may limit public detail. A sealed event should not be filled with guesses. State only that the public trail is incomplete and use the proper agency request route. The court docket remains more durable than a current facility roster after the person moves.
USMS Cass Jail Transfer
If Cass County Jail first held the person, Cass’s adult jail register can contain the commitment number, admit/discharge date, offense, sentence length, and discharge type. Ask for the receiving agency or destination if maintained and public. A recorded transfer to USMS closes the Cass custody phase but begins or continues federal custody.
Minnesota Statutes section 13.82, subdivision 2, supports access to the date, time, and legal basis for release from county custody or incarceration. Section 13.85 can protect classified corrections information. A focused request should seek the public fields without asking Cass to create a federal timeline it does not maintain.

The Cass request-form route is appropriate for the local custody event. The federal court or USMS must answer federal questions. Calling Cass alone cannot establish whether a later federal detention order was changed or whether USMS delivered the person to another custodian.
USMS Cass Release Destinations
A person leaving a USMS contract bed can be released under federal court conditions, transported to court, returned to a different contract facility, designated to BOP after sentence, delivered to a state or local warrant holder, or transferred to ICE. The physical exit looks similar from outside. The legal destination is what determines whether community release occurred.
- Pretrial release
- Court-authorized release before the federal case is resolved, usually subject to stated conditions.
- Commitment
- Legal delivery of the person for service of a sentence or another custody purpose.
- Contract custody
- Housing supplied by another facility while USMS retains the federal custody role.
- Detainer
- A notice that another authority may seek custody after the present hold.
Federal supervision after a pretrial release is not BOP custody. After sentencing, supervised release is also a court-imposed community status distinct from prison. The docket identifies the legal terms. A BOP locator result can later document the sentenced-custody phase, but it should not be backdated to explain the earlier USMS event.
USMS Release Records Request
A USMS FOIA request should identify the person, federal case, date range, facility or district if known, and the specific existing record sought. Useful targets may include a custody or movement record, subject to federal exemptions and privacy limits. The request should not demand that USMS create a new narrative, interpret the court’s order, or certify where the person lives now.

A focused request can ask for an existing movement or custody record tied to a defined period. It should include the federal case number and known identifying details, then state the exact event being traced. Broad requests for “all information” make it harder to separate the court order, transport record, and contract-facility log. Narrow wording also makes clear that the request seeks maintained data rather than a new explanation.
Records may be withheld in whole or part under federal law. A denial or redaction does not prove release or custody. It only defines what was provided through that channel. Preserve the order, locator observation, and local record separately.
USMS Versus BOP Release
USMS and BOP are both federal, but the public search path changes with the custody stage. Mixing them can create a false no-result. Federal pretrial detention belongs in the docket and USMS trail. Sentenced federal imprisonment belongs in BOP’s locator and the judgment.

For a Cass connection, also determine whether Cass ever booked the person. A federal case involving someone from Cass County can have no Cass jail record at all. Verify USMS Community Release
A supportable finding names the authority and stage. The federal court authorized release under the cited order. The contract facility recorded physical departure. No receiving custodial agency appears in the available trail, or a named agency accepted custody. This precise wording is better than saying someone was simply “released from jail.”
No official Cass-specific USMS release time, pickup point, contract facility, or transportation arrangement was documented. Court and facility operations can change. Confirm any immediate logistics with the authority named in the live record, and never infer operating hours from a clerk or records schedule.
For final review, place the federal order, facility movement, and any receiving-agency record in time order. A gap should remain labeled as a gap. It should not be filled with a presumed community release merely because the public docket has no later entry.
This method also protects against a common identity error. Federal dockets and local rosters may format names differently. Match case number, birth data where public, and the known facility or identifier before joining the records.
